1. APPLICATION OF THIS PRIVACY POLICY

Viking’s Privacy Policy applies to personal information collected by Viking, whether we have asked for the information or not. Viking is governed by the Australian Privacy Principles (APPs) under the Privacy Act 1988 (Cth). The APPs govern the way in which we collect, use, disclose, store, secure and dispose of your personal information. A copy of the APPs may be obtained from the website of the Office of the Australian Information Commissioner at www.aoic.gov.au.

Viking will review this policy regularly, and may update it from time to time. If we make changes, we will post those changes on the privacy page of Viking’s website.

2. COLLECTION AND USE OF PERSONAL INFORMATION

2.1 WHY WE COLLECT PERSONAL INFORMATION

Viking collects personal information about you:

• because we need it to provide a product or service that you have requested, for example, if you have requested information from the Viking website, or agreed to participate in a river cruise with Viking;
• because you work for us, or apply to us for a job or work experience.
  We may also use your personal information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. When we collect personal information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.

2.2 HOW WE COLLECT INFORMATION

Broadly, there are two types of information or data we collect:

1. Information that you specifically give us

For example, you may provide information about yourself when you are filling in a form. This type of information may include your name, images of you, your contact details (your home address, business address, telephone number, business telephone number, email address) and date of birth. The information that you give us may be:

• Personal information that is required. In some instances, you must provide personal information if you wish to use a particular service or participate in an activity. For example, Viking does not sell products to people under the age of 18 years.
• Personal information that is optional. You may choose to provide some personal information which is not required but is directly related to Viking’s functions or activities (such as preferences or opinions). Usually this type of information will enable Viking to improve or broaden the services we can offer you. If you choose not to provide this optional information, we would still be able to offer you the service, but perhaps with fewer options than if you had provided the optional information. For example, if you tell us you are interested in a particular destination, we may be able to provide you with specific Viking content that matches your interests and we may keep a record of this information provided. If you provide us with unsolicited information that we do not require or which is not directly related to Viking’s functions or activities, Viking may be required to destroy or de-identify that information, provided it is lawful and reasonable to do so.
• Permissions. Sometimes you will be asked to confirm that you agree to a particular activity. For example, you may need to expressly agree that you would like to receive a newsletter or to confirm that you agree to the terms and conditions of a competition.
  You may be able to make changes to the information you provided us (for example, if you change your email address) or withdraw the permission you gave us for a particular service. We will make it clear how you do that.

• 2. Data we collect that tracks your activity

  We use an email delivery and marketing company to send emails to you. Pixel tags and cookies are used in those email messages and at our website to help us measure the effectiveness of our marketing and how visitors use our site.

  Pixel tags (sometimes also called “clear GIFs”) are small graphic files, invisible to the human eye, which allow websites or other online services to track users. Viking and our third-party advertising company uses pixel tags in HTML-enabled emails to track whether (and when) you opened our message.

  The data on your use of our site may be linked to personal information you have chosen to share with us when you register. Most Internet browsers automatically accept cookies. However, you can instruct your browser, by editing its options, to stop accepting cookies or prompt you before accepting a cookie from the sites you visit.

  If you decide not to accept our cookies, your ability to use some features on our site may be impaired. Certain visitors to our site may have previously received targeted promotional materials relative to the site. Viking may share site usage information about such visitors with reputable third parties for the purpose of targeting future campaigns and upgrading visitor information used in reporting statistics. Although our marketing company logs the information coming from our site on our behalf, we control how that data may and may not be used.

  Our website does not collect personally identifiable information about individuals except when such individuals specifically provide such information on a voluntary basis, such as when registering at our website, requesting a brochure or video, or accessing our "request a quote" feature.

  3. DISCLOSURE OF PERSONAL INFORMATION

  3.1 DISCLOSURE OF PERSONAL INFORMATION TO THIRD PARTIES

  Viking may disclose your personal information to third parties such as airlines for the following purposes:

  • to provide the service you wish to use;
  • to customise and promote Viking services which may be of interest to you;
  • to provide technical support to you to use Viking’s services;
  • if permitted or required by law; or
  • otherwise with your consent.

  In many cases, Viking imposes contractual restrictions equivalent to those imposed on Viking under the Privacy Act in respect of collection and use of personal information by those third parties. In some cases, Viking’s ability to impose contractual restrictions is limited. In those circumstances, Viking will carefully consider the risks to the protection of personal information when entering into arrangements with third parties.

  These third parties may be located in Australia or overseas.

  We may share your email address and home address with third parties to deliver brochures, videos, information about cruise promotions, news and other information about our website, products, services or special promotions on our behalf.

  Viking may also disclose your personal information (excluding sensitive information about you) to third parties for the purposes of direct marketing Viking’s services including brochures, videos, information about cruise promotions, news and other information about our website, products, services or special promotions.
  
  You will be able to opt-out of direct marketing at any time if you so choose. Under no circumstances will Viking sell or receive payment for licensing or disclosing your personal information.

  4. ACCESSING YOUR PERSONAL INFORMATION

  You have the right to request access to personal information that is held by Viking about you.

  You also have the right to request the correction of any of your personal information that Viking holds. Viking will take reasonable steps to make appropriate corrections to personal information so that it is accurate, complete and up-to-date.   We may use information that we know about your likes and interests to tell you about other Viking programs, products and services. We may know about your likes and interests because you have provided that information.

  6. PROTECTION OF YOUR PERSONAL INFORMATION

  Your personal information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure. When your personal information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your personal information. However, most of the personal information is or will be stored in client files which will be kept by us for a minimum of 7 years.
  
  Viking has implemented appropriate physical, electronic and managerial security procedures in order to protect personal information from loss, misuse, alteration or destruction. Viking regularly reviews security and encryption technologies and will strive to protect information to the fullest extent possible (subject to any legal obligation to disclose data – for example, in compliance with a warrant issued under the Clarifying Lawful Overseas Use of Data (CLOUD) Act). Viking is also compliant with its obligations under the Notifiable Data Breaches (NDB) Scheme and the Payment Card Industry Data Security Standard (PCI DSS).
  
  We encourage you to be vigilant about the protection of your own personal information when using third party digital services.

  7. CREDIT CARD INFORMATION

  Crucially, your credit card details are only stored and transmitted in encrypted form. Unencrypted credit card information is NOT stored on our internet servers. Online credit card payments are currently processed using a third party payment gateway service run by TokenEx.
  
  If you use your credit card and the transaction is manual rather than electronic, the imprinted record will be stored by Viking for the period that financial records are required to be retained.

  8. OFFLINE PURCHASES

  If you do not wish to place your order on the internet, we offer you the option of phoning, faxing or mailing in your order.

  9. PRIVACY AND CHANGE OF CONTROL

  In the event Viking goes through a business transition, such as a merger, being acquired by another company, or selling a portion of its assets, users’ personal information will, in most instances, be part of the assets transferred.

  Our website may contain links to other sites. We are not responsible for the privacy practices or the content of such web sites. We encourage you to read the privacy statements of any linked sites as their privacy policy may differ from ours.

Viking ‘Empires of the Mediterranean' Cruise Promotion 

CONDITIONS OF ENTRY

1. Information on how to enter, mechanics of entry and Prizes form part of these Conditions of Entry. Entry into the promotion is deemed acceptance of these Conditions of Entry.
2. Entry is open to residents of Australia and New Zealand 18 years and above (Entrants). Employees (and their immediate families) of the Promoter, travel agents and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or 1st cousin.
3. The Promoter is Viking River Cruises Australia Pty. Ltd (ABN 81 131 274 372), 601/66 Wentworth Avenue, Surry Hills. NSW 2010. (Promoter).
4. Promotion commences at 12.01am (AEST) on 1 September 2023 and ends at 11.59pm (AEDT) on 30 November 2023 (“Promotional Period”).
5. To enter, Entrants must log on to https://www.viking.com/win and submit their entry within the Promotion Period.
6. By entering, Entrants must also agree to the competition Terms and Conditions.
7. Once an Entrant has submitted their completed entry they will be treated as having submitted one (1) entry into the Promotion. One entry per eligible email address will be permitted.
8. Entries will be deemed accepted at the time of receipt by the Promoter and not at the time of transmission. Entries received will be considered final by the Promoter. Incomplete, inaccurate, erroneous, ineligible or incomprehensible entries will be deemed invalid. The Promoter accepts no responsibility for late, lost or misdirected entries. There is no cost to enter the promotion.
9. The Draw from all eligible entries will be conducted at 2.00pm (AEDT) on 7 December 2023, at MDSA, Level 16, 1 Denison Street, North Sydney, NSW, 2060. The first eligible entry drawn will be, upon verification by the Promoter, the Winner of the Promotion.
   
    The winner will be notified by phone and in writing immediately after the Draw, and will be announced on https://www.viking.com/win on 11 December 2023, for a minimum of 28 days. The Winner will also be announced in The Australian and New Zealand Herald newspapers on 14 December 2023.
10. The Grand Prize is a Viking “Empires of the Mediterranean” Cruise for two people, leaving Athens on 21 October 2024 for 10 days and 9 nights. Flights are not included.

    Cruise is valued at $9,195pp. The maximum retail value of the Grand Prize is $18,390.
    
    Additional terms and conditions for the Grand Prize;
    
    • Travel or entry documentation (Visas) and arrival fees are the responsibility of the Winner and their travel companion. It is the Winner’s responsibility to check with all government travel advisory and immigration authorities regarding travel requirements and eligibility. Any fines, penalties, payments and expenditure incurred as a result of not meeting such requirements will be the sole responsibility of the Winner and their travel companion.
    • Any mandatory conditions related to taking the prize, including COVID-19 vaccinations for any travel outside of Australia, are the responsibility of the Winner and their travel companion. If the Winner or their travel companion have not complied at the time of travel, boarding may be denied and the prize duly forfeited. This includes any third party vaccination requirements from any travel operator required to take the prize. If travel and quarantine restrictions imposed by the Australian or International Governments impact the Winner’s ability to take the prize as stated, Viking will make every effort to defer the departure date to a date of their choosing.
      
      
11. If the Prize is unclaimed or forfeited by 5:00pm (AEDT) on 7 March 2024, a second chance draw will take place at the same place and time as the original draw on 14 March 2024.
     The winner, if any, will be notified by phone and inwriting by email on 18 March 2024 and will be announced on https://www.viking.com/win on 25 March 2024, for a minimum of 28 days. The Winner will also be announced in The Australian & New Zealand Herald newspapers on 25 March 2024.
12. The Prize is not transferable or exchangeable and cannot be taken as cash. The Prize must be taken as offered and cannot be varied. If for any reason the winner is unable to accept the prize as stated, the winner will forfeit the prize and no compensation will be given in lieu. The Promoter accepts no responsibility for any tax implications that may arise from the Prize winnings. The Prize value is accurate as of 31 July 2023, and the Promoter is not responsible for any variation in values. Prize values are in Australian dollars and recommended retail price includes GST where applicable. Prize supplier conditions apply.
13. The winner and their travelling companion must be a minimum of 18 years of age. Prize Terms & Conditions apply. The Prize is subject to availability. Any changes or costs incurred once the tickets have been issued, will be the sole responsibility of the winner.
14. All elements of the Prize must be taken together. Travel restrictions may apply. The winner and their travel companion must travel together. Any meals or tips which are not included in the Cruise, transfer fees, Passports, Visas, telephone charges, laundry, additional nights or upgrades, any other personal expenses, travel insurance, return flights and airport transfers are the responsibility of the winner and their travel companion. If for any reason the winner is unable to accept the Prize as stated, and within the date indicated, the winner will forfeit that Prize and no compensation will be given in lieu.
15. Any travel or entry documentation and arrival fees are the responsibility of the winner and their travel companion. It is the winner’s responsibility to check with all government travel advisory and immigration authorities regarding travel requirements and eligibility. Any fines, penalties, payments and expenditure incurred as a result of not meeting such requirements are the sole responsibility of the Winner and their travel companion.
16. If any portion of the Prize is unavailable, for whatever reason, the Promoter reserves the right to substitute the Prize, or that element of the Prize, for a Prize of similar theme and of equal value, subject to State regulation and subsequent approval.
17. In the event of war, terrorism, state of emergency, pandemic, disaster or any other circumstance beyond the control of the Promoter, the Promoter reserves the right to either provide an alternative travel destination to the same value as the original Prize or, subject to any applicable laws or written directions made under applicable legislation, to cancel, terminate, modify or suspend the promotion. The Promoter and the associated agencies, make no representation as to the safety, conditions or other issues that may exist at any destination. It is the sole responsibility of the Winner and guest to first check with all government travel advisory information regarding the safety and situation of the destination of their chosen destination/event.
18. The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permitted by law and the Promoter shall not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law. The Promoter is not responsible for any incorrect or inaccurate information, either caused by entrant or for any of the equipment or programming associated with or utilised in this Promotion, or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, delay in operation or transmission, communications line or telephone, mobile or satellite network failure, theft or destruction or unauthorised access to or alteration of entries.
19. The Promoter is not responsible for any cancellation, postponement, delay or rescheduling of transport and any costs incurred as a result, including, without limitation, any accommodation costs will be the sole responsibility of the Prize winner.
20. Entrants can only enter in their own name. Entrants who provide incorrect, misleading or fraudulent information are ineligible to participate in the promotion and all entries of an Entrant who is deemed by the Promoter to have provided incorrect, misleading or fraudulent information may, at the discretion of the Promoter, be deemed invalid. The Promoter reserves the right to request the Entrant produce (within the requested time) appropriate photo identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Entrant’s identity, age, residential address, eligibility to enter and claim a Prize, and any information submitted by the Entrant in entering the promotion, before issuing a Prize.
    
    If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or an Entrant or entry has not been verified or validated to the Promoter’s satisfaction then all the entries of that Entrant will be ineligible and deemed invalid.
21. It is a condition of accepting the Prize that the winner may be required to sign a legal release in a form determined by the Promoter in its absolute discretion.
22. The Prize will only be awarded following any winner validation and verification that the Promoter requires in its sole discretion.
23. The use of any automated entry software or any mechanical, electronic or other means that allows an Entrant to automatically enter repeatedly is prohibited and will render all entries submitted by that Entrant invalid.
24. The Promoter and its associated agencies and companies are not liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with taking any Prize or using any Prize, except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
25. The Promoter and its associated agencies and companies are not responsible for any problems, delays or technical malfunction of any telephone or network or lines, servers or providers, fax equipment, computer equipment, software, technical problems or traffic congestion on a network or a mobile network or any combination thereof, or any other technical failures including any damage to Entrants or any other persons fax equipment, mobile handset, computer or peripherals related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
26. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter including but without limitation technical malfunctions or failures.
27. If for any reason this promotion is not capable of running as planned for any reason beyond the reasonable control of the Promoter including because of war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the promotion and/or if necessary to provide an alternative prize or prizes to the same value as the original Prize, subject to any applicable laws or written directions made under applicable legislation.
28. The Promoter reserves the right to verify the validity of any and all entries and reserves the right to disqualify any Entrant for: (a) tampering with the entry process; (b) for submitting an entry which is not in accordance with these Conditions of Entry; or (c) if the Entrant is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
29. As a condition of entering this promotion, an Entrant consents to, in the event they are a winner, the Promoter using the Entrant’s image and caption, name, likeness, image, voice (including photograph, film and/or recording of the same), and/or entry in any media for an unlimited period of time and worldwide without further notification, remuneration or compensation for the purpose of promoting, publicising or marketing the promotion (including any outcome), and/or promoting any products or services manufactured, distributed and/or supplied by the Promoter and their associated or affiliated companies. The Entrant agrees that, in the event they are a winner; the Entrant will participate in all reasonable promoted activities in relation to the Promotion as requested by the Promoter and its agents.
30. An entry and any copyright subsisting in an entry irrevocably becomes, at time of entry, the property of the Promoter and may be used by the Promoter at any time. The Promoter collects personal information about an Entrant to include the Entrant in the promotion and, where appropriate, award Prizes. If the personal information requested is not provided, the Entrant cannot participate in the promotion and is deemed ineligible. An Entrant can gain access to, update or correct any personal information held by the Promoter by contacting the Promoter’s Privacy Officer at the address in condition 3 of these Terms & Conditions. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter.
31. By participating in this Promotion, Entrants consent to the storage of their entry information on the databases of the Promoter. In addition, Entrants agree to the Promoter using their entrant details for the purpose of sending information on offers and promotions by mail, phone/SMS/MMS and/or email, for an indefinite period, or until such time that an Entrant notifies the Promoter, or opts out from receiving these communications.
    
    Further information as to; how the Promoter handles Entrant information; how entrants can complain about any breach of the Australian Privacy Principles; how the Promoter will deal with a complaint of that nature and how entrants can access or seek correction of any data collected in a Promotion will be handled in accordance with the Promoter’s Privacy Statement, a copy of which is available by contacting the Promoter. Refer to condition 3 of these Terms & Conditions.
